Last updated: September 18, 2026  ·  These terms govern your use of the TonFair platform at tonfair.com and any associated services.

1. Introduction & Acceptance

1.1 These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you") and TonFair ("Platform", "we", "us") governing your access to and use of the TonFair prediction market platform, including all smart contracts, interfaces, APIs, and related services.

1.2 By connecting a wallet, placing an order, or otherwise accessing the Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must immediately cease using the Platform.

1.3 These Terms apply alongside TonFair's Privacy Policy and any additional guidelines published on the Platform. In the event of conflict, these Terms take precedence.

1.4 TonFair is a decentralized peer-to-peer prediction market. We act as a protocol operator and do not take positions against users. All outcomes are settled by on-chain smart contracts. Results of platform events are subject to oracle verification; results of user-created events are set by their creators and are not verified by TonFair (see §6.5).

2. Eligibility

2.1 Age Requirement

You must be at least 18 years of age to use TonFair. By using the Platform you represent and warrant that you are 18 years of age or older. In jurisdictions where the minimum legal age for participation in prediction markets or gambling activities is higher than 18, you must meet that higher age requirement.

We reserve the right to request age verification at any time and to suspend or terminate access for users who do not meet the age requirement. Minors who access the Platform in violation of this provision do so without authorization, and any resulting positions or transactions may be voided.

2.2 Geographic Restrictions

The Platform is not available in the following jurisdictions. You represent and warrant that you are not located in, incorporated in, or a resident or national of any Restricted Jurisdiction.

Access to TonFair is restricted in the following countries and territories ("Restricted Jurisdictions"), either because prediction markets are legally prohibited, require local licensing that TonFair does not hold, or due to international sanctions:

2.3 Use of VPNs, proxies, or other technical means to circumvent geographic restrictions is strictly prohibited and constitutes a material breach of these Terms.

2.4 TonFair operates on a public blockchain; we do not control access at the protocol level. However, by using the Platform interface you represent that you are not a resident of a Restricted Jurisdiction. If we become aware that you are, we may immediately suspend your interface access.

2.3 Account Requirements

2.3.1 You must have a compatible TON blockchain wallet to use the Platform. You are solely responsible for the security of your wallet and private keys.

2.3.2 You may not access the Platform on behalf of another person without their explicit written consent, nor create multiple accounts to circumvent restrictions or limits.

3. Platform Description

3.1 TonFair is a peer-to-peer prediction market built on the TON (The Open Network) blockchain. Users place opposing predictions on real-world events (sports matches, financial outcomes, etc.) and are matched against each other — not against the Platform.

3.2 The Platform operates an order book where buy and sell orders are matched at agreed prices. Once matched, the position is funded through on-chain smart contracts and settled automatically upon event resolution.

3.3 Participation in prediction markets involves financial risk. You may lose the funds committed to any position. Past results do not guarantee future performance. TonFair does not provide investment, financial, legal, or tax advice.

4. Fees & Charges

4.1 Platform Commission

TonFair charges a commission on the net profit of the winning side, on a sliding scale from 5% (base rate) down to 0%. The rate is assigned automatically by a Market Maker SLA program, based on the user's quoting activity in the order book — no agreements, applications, or manual approval. Losers pay no commission — only the winner pays, on their profit, at their own rate.

4.1.1 The commission is deducted automatically by the smart contract at payout. Six tiers span the range from the 5% base rate to 0%; a user's tier is assigned and removed continuously based on how much and how consistently they quote both sides of a market (coverage and uptime), without any agreement between the user and TonFair.

4.1.2 A deal locks in, permanently and on-chain, the rate that applied to each side at the moment it was matched. Later changes to a user's tier do not affect deals already matched.

4.1.3 The qualification thresholds for each tier are set by TonFair and may change from time to time; such changes affect only deals matched after the change.

Example (base 5% tier): User A and User B each stake 10 TON on opposing outcomes, both at the base rate. The winner receives 19 TON (10 TON returned + 9 TON profit after 5% commission on 10 TON profit = 0.5 TON fee). TonFair collects 0.5 TON. Loser receives nothing. A user on a lower tier pays a proportionally smaller fee on the same profit.

4.2 Blockchain Gas Fees

4.2.1 All transactions on the TON blockchain require gas fees paid in TON. These fees are independent of TonFair and are paid to TON validators, not to TonFair.

4.2.2 Gas fees are incurred at several stages of the lifecycle:

4.2.3 Gas costs are determined by the TON network at the time of transaction and may fluctuate. TonFair does not profit from gas fees and does not guarantee any specific gas cost.

4.3 No Hidden Fees

There are no additional subscription, deposit, or withdrawal fees charged by TonFair beyond the winner's commission described in section 4.1.

4.4 User-Created Events

For user-created events (§6.5) the same 5% cap on the winner's net profit applies regardless of either party's Market Maker SLA tier (§4.1) — the sliding scale does not apply to user-created events. The 5% is split: the event creator receives up to 4% and TonFair receives 1%. The split is fixed in the EventPool smart contract when the event is deployed and cannot be changed afterwards.

5. Sports Settlement Rules

Settlement rules differ by sport — check the table in §5.2 for each discipline. For football/soccer and ice hockey, settlement is based on regular time only (no extra time, no penalty shootout, no overtime, no shootout rounds). For basketball, American football, and baseball, standard bets include overtime/extra innings. Full details are defined per sport below.

5.1 General Principle

5.1.1 TonFair event results are sourced from the same official data providers used to propose outcomes on-chain. Settlement rules for each sport follow the same standards used by those data providers, as detailed in §5.2.

5.1.2 Football/Soccer example: If a knockout match ends 1–1 after 90 minutes and the winning team is decided in extra time and penalties, TonFair settles the "Match Result" market as a draw (the regular-time score). The penalty shootout result does not affect settlement.

5.1.3 Ice hockey example: If a match ends 2–2 after 60 minutes (3 regular periods) and the winning team scores in overtime, TonFair settles the "Match Result" market as a draw. The overtime and shootout goals are not included.

5.1.4 All results are taken from official competition data and/or verified data providers (Betradar, Flashscore, official federation sources, etc.). In the event of a discrepancy between data sources, TonFair's oracle (see §6) makes the final determination. This section and the oracle apply to platform events only; user-created events are governed by §6.5.

Note on individual bet types Some specific bet types (e.g. 4th quarter result in basketball, 2nd half in American football) may be settled without overtime, regardless of the sport's general rule. Any such exceptions will be stated in the event description on the Platform.

5.3 Match Postponements & Cancellations

5.3.1 Soccer, American football, volleyball: if a match is cancelled or postponed for more than 48 hours, all open positions are cancelled and funds returned. If interrupted and not completed within 54 hours, same result applies — unless the match is considered to have taken place (see §5.3.3).

5.3.2 Basketball, ice hockey, handball, baseball, rugby, bandy, futsal, water polo: if a match is cancelled or postponed for more than 15 hours, positions are cancelled and funds returned. If interrupted and not completed within 30 hours, same result applies — unless the match is considered to have taken place (see §5.3.3).

5.3.3 A match is considered to have taken place if it was interrupted but played at least the following amount of time (results settled on the score at the point of interruption): Soccer — 60 min; Basketball (4×12) — 40 min; Basketball (4×10) — 35 min; Ice hockey — 50 min; American football — 50 min; Baseball — 5 complete innings.

5.3.4 Tennis, badminton, table tennis, beach volleyball, squash: if a match is interrupted and not completed on the same day, positions remain in force until the match is completed or one participant retires. If cancelled entirely, positions are settled at odds "1" (funds returned).

5.4 Walkovers & Forfeits

If one team or competitor forfeits, withdraws, or is disqualified before or during the event, the opposing side wins. Any subsequent appeal or reinstatement by the governing body does not affect TonFair's settlement once it has been processed on-chain.

5.5 Result Source

5.5.1 Settlement is based on the official result at the time the event concludes, as reported by official competition sources (federation/league websites, official protocols) and/or verified data providers. If the official result is later changed (e.g. due to post-match disqualification, referee error review), the settlement is not revised — the original final score at the time of settlement stands.

5.5.2 In the event of a discrepancy between sources, the oracle (§6) adjudicates using the best available official information. For user-created events there is no oracle adjudication (§6.5).

6. Event Result, Disputes & User-Created Events

Sections 6.1–6.4 apply to platform events — events listed and resolved by TonFair. User-created events follow different rules, described in §6.5.

6.1 Result Proposal

6.1.1 After a platform event concludes, TonFair's automated system proposes an official result by submitting a ProposeResult transaction to the relevant EventPool smart contract on the TON blockchain.

6.1.2 The proposed result is derived from trusted data providers. The proposal initiates a 6-hour challenge window during which any participant in the market may contest the result.

6.2 Challenge Window (6 Hours)

Any participant may challenge a proposed result within 6 hours of proposal. To submit a challenge, a user must send a Challenge transaction to the EventPool contract accompanied by a non-refundable dispute deposit of 10 TON. This deposit deters frivolous challenges.

6.2.1 If no challenge is received within the 6-hour window, the proposed result is considered final and the settlement (Settle) transaction can be submitted to distribute funds.

6.2.2 The fate of the 10 TON deposit depends on the oracle's ruling:

6.3 Oracle Adjudication

6.3.1 If a valid challenge is received, the event enters DISPUTED status. TonFair notifies the designated oracle, which independently reviews the event outcome using official competition data.

6.3.2 The oracle submits an OracleResolve transaction to the EventPool contract with its final determination. This decision is cryptographically signed and permanently recorded on the TON blockchain.

6.3.3 The oracle's decision is final and binding. Once the oracle resolves the dispute, no further appeal is possible within the Platform. The EventPool contract transitions to RESOLVED status, and settlement proceeds automatically.

6.3.4 The maximum dispute resolution period is 3 days from the time the challenge is raised. If the oracle fails to resolve within this emergency window, an emergency withdrawal mechanism is activated.

6.4 Settlement

6.4.1 Settlement is executed via a permissionless Settle transaction to the EventPool contract, callable by anyone after: (a) the 6-hour challenge window expires without challenge, (b) the oracle resolves a dispute, or (c) TonFair submits the settlement 7 hours after ProposeResult as a safety buffer.

6.4.2 The EventPool contract computes the payout, deducts the platform commission at the rate locked in for the deal (§4.1), and transfers the winner's proceeds directly to their personal Vault contract. No Platform intermediary holds or controls funds at this stage.

6.4.3 By using the Platform, you acknowledge and accept TonFair's settlement process and the oracle's final authority over disputed outcomes of platform events.

6.5 User-Created Events

User-created events cannot be challenged. Participation is based solely on your trust in the event creator. TonFair does not know, verify, or guarantee the real-world outcome of a user-created event, and is not responsible for the result its creator sets.

6.5.1 Who sets the result. A user-created event is created by a Platform user (the "creator"), who is the sole source of its result. TonFair cannot know the outcome of private matches, local tournaments or personal disputes and does not check it.

6.5.2 No challenge, no oracle. The challenge window (§6.2) and oracle adjudication (§6.3) do not apply. The EventPool smart contract rejects any Challenge transaction for a user-created event, and the dispute deposit is returned to the sender's Vault.

6.5.3 Finality. The creator may set the result of each market once the market has ended. The result becomes final 60 seconds after it was last changed; within that minute the creator may correct it. After that, anyone may submit the Settle transaction and the smart contract pays the winners.

6.5.4 Trust and reputation. Before trading, evaluate the creator yourself: their wallet address, history of previous events and, where available, their public rating. TonFair displays this information for convenience only and does not endorse any creator.

6.5.5 Missing result. If the creator does not set a result within 3 days after the market ends, any participant may call Settle and the smart contract refunds all positions (§6.3.4 emergency mechanism).

6.5.6 Abuse. Setting a knowingly false result, colluding with participants, or trading against your own event through affiliated accounts violates §8. TonFair may suspend interface access for such creators and their events, but cannot reverse a settlement already executed on-chain.

7. Non-Custodial Architecture & User Funds

TonFair does not hold, custody, or control user funds at any time. All TON tokens remain in user-owned smart contracts or event contracts on the TON blockchain. TonFair's platform interface and backend servers never have direct access to your funds.

7.1 Personal Vault Contract

7.1.1 Each user has a personal Vault smart contract deployed on the TON blockchain. The Vault address is deterministically derived from the user's wallet address and the TonFair operator address.

7.1.2 Your Vault holds your available balance. Depositing TON to your Vault gives you a trading balance on TonFair. Funds in your Vault are controlled exclusively by your private key — TonFair cannot unilaterally move or access them.

7.1.3 When you place an order, the corresponding amount is reserved (locked) within your Vault balance to prevent over-commitment, but the funds remain in your Vault contract until a match is made.

7.2 EventPool Contract

7.2.1 When two opposing orders are matched, the Platform instructs both users' Vault contracts to transfer the staked amounts to a dedicated EventPool smart contract specific to that event.

7.2.2 Funds held in an EventPool contract are locked for the duration of the event and cannot be accessed by either the Platform or either participant until settlement. The contract code is open-source and verifiable on the TON blockchain.

7.2.3 After settlement, the EventPool contract automatically sends the payout to the winning user's Vault contract. TonFair's commission is collected by the contract at this point.

7.3 Withdrawals

7.3.1 You may initiate a withdrawal from your Vault at any time, provided you have no open (unmatched) orders. If open orders exist, they are automatically cancelled before the withdrawal is processed.

7.3.2 While a withdrawal is pending, you may not place new orders. This restriction is enforced by the Platform interface and the Vault's on-chain state.

7.3.3 TonFair does not guarantee any specific withdrawal processing time; timing depends on TON blockchain confirmation speeds.

7.4 No Fiat Currency

TonFair operates exclusively with TON (the native cryptocurrency of The Open Network). No fiat currency deposits or withdrawals are supported. All values displayed on the Platform are denominated in TON.

7.5 Risk of Smart Contract Vulnerabilities

While TonFair's smart contracts are designed and audited to the best of our ability, no software is guaranteed to be free of vulnerabilities. In the event of a smart contract exploit or unforeseen bug, TonFair's liability is limited as described in section 9. You use the Platform at your own risk.

8. Prohibited Activities

You agree not to engage in any of the following activities when using TonFair:

Violation of any prohibition in this section may result in immediate suspension of interface access and, where legally required, reporting to relevant authorities.

9. Disclaimers & Limitation of Liability

9.1 No Warranties. The Platform is provided "as is" and "as available" without any warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement. TonFair does not warrant that the Platform will be uninterrupted, error-free, or that defects will be corrected.

9.2 Financial Risk. Participation in prediction markets involves substantial risk of financial loss. You may lose all funds committed to a position. You should only participate with funds you can afford to lose. TonFair is not a regulated financial institution and does not provide financial advice.

9.3 Blockchain Risks. You acknowledge the inherent risks of blockchain technology, including but not limited to: network congestion, transaction failures, smart contract vulnerabilities, oracle failures, hard forks, and regulatory changes affecting the TON network.

9.4 Limitation of Liability. To the maximum extent permitted by applicable law, TonFair's total aggregate liability to you for any claims arising from or related to these Terms or your use of the Platform shall not exceed the Platform commission fees paid by you in the 30 days preceding the event giving rise to the claim.

9.5 Exclusion of Consequential Damages. TonFair shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or goodwill, even if advised of the possibility of such damages.

9.6 Indemnification. You agree to indemnify and hold TonFair, its operators, and affiliates harmless from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms or applicable law.

10. Governing Law

10.1 These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TonFair operates, to the extent applicable.

10.2 In the event of any dispute between you and TonFair arising from these Terms or your use of the Platform, the parties agree to first attempt to resolve the dispute informally by contacting TonFair (see section 12). If the dispute cannot be resolved informally within 30 days, either party may pursue available legal remedies.

10.3 For disputes regarding the settlement of platform event outcomes, the oracle adjudication process described in section 6 constitutes the binding and final resolution mechanism, and no external legal proceedings shall override a final on-chain oracle resolution. For user-created events, the result set by the creator and finalized on-chain (§6.5) is final; any claim regarding it lies solely between the participants and the creator.

11. Changes to These Terms

11.1 TonFair reserves the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page and, where practicable, by posting a notice on the Platform or via Telegram.

11.2 Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must cease using the Platform.

11.3 Changes to sports settlement rules (section 5) take effect only for events created after the effective date of the change. Existing open positions are settled under the Terms in force at the time the position was opened.
